Must be a legal U.S. resident 18 years of age or older to enter and claim any prize. Employees and their immediate family members of Favored Nations LLC (“FN”), Ibanez Musical Instruments Corporation, Mesa/Boogie Ltd., CMP Entertainment Media, Inc., and Sony DADC are not eligible to participate. This contest is void where prohibited by applicable law. Contest ends 8/31/2006. A Grand Prize drawing will take place at Favored Nations’ offices the week of 9/01/06 between the participant who receives the Prize Winning Insert found in one (1) copy of Andy Timmons Band Resolution CD, and one winner of the on-line entries. The winner of the Grand Prize drawing will receive the Grand Prize, with the other participant receiving the Second Prize. The winner of the on-line entry will be selected at random from entries received for the online contest before 8/31/06. The participant who receives the Prize Winning Insert found in one (1) copy of Andy Timmons Band Resolution CD must inform FN via FN’s website, e-mail or telephone that participant has received the insert and presents such insert to FN pursuant to FN’s forthcoming instructions. If the Prize Winning Insert is not claimed by 8/31/06, the Grand Prize and Second Prize will be selected at random from entries received for the online contest before 8/31/06.
2. Third Prize winners will be selected from participants who submitted their Participant Info to FN via FN’s website. Third Prize winners will be selected by random drawing during the week of 9/1/2006. Random drawings will be made at FN’s Los Angeles, California office during the week of 9/1/2006. FN reserves the exclusive right to interpret all conditions and these Contest Rules in regard to this Contest without claim for damage or recourse of any kind. By participating, contestants agree to be bound by these Contest Rules and FN’s judging decision, which shall be final. If contestant selected by random drawing as a winner of the Grand Prize, Second Prize or Third Prize is ineligible to participate in the contest pursuant to these Contest Rules, then another drawing will be made. Odds of winning the Grand Prize will be one in two, between the participant who receives the Prize Winning Insert found in one (1) copy of Andy Timmons Band Resolution CD, and one winner of the on-line entries. Odds of winning a Prize will be determined by the number of Andy Timmons Band Resolution CDs purchased as well as entries received for the online contest before 8/31/06.
3. Winners will be notified via email & telephone by FN. Notification via email & telephone are the only ways a winner will be contacted. If winning contestant does not contact FN within forty-eight (48) hours after FN’s email & telephone notification, then FN reserves the right to select an alternate winner in FN’s sole discretion. Each winner will be required to sign an affidavit of eligibility and releases of liability and publicity. If the affidavit and releases are not returned within the requested time period, properly executed, or are returned as undeliverable, an alternate winner will be selected in FN’s sole discretion.
4. Grand Prize winner will receive one (1) Mesa Boogie Lone Star Head & one (1) Stiletto Deuce Head, with one (1) 4x12 Rectifier Standard Slant Cab, one (1) Ibanez AT300 Andy Timmons Signature Model Custom Guitar, and a one (1) year subscription to Guitar Player magazine (valued at six thousand, one hundred and eighty one dollars and ninety-nine cents [$6,181.99]. Second Prize winner will receive an Ibanez SA160 Guitar, a one (1) year subscription to Guitar Player magazine, and one (1) signed copy of the Andy Timmons Band Resolution CD (valued at $477.98). Third Prize winner will receive one (1) CD copy of each album title released by FN to date, a one (1) year subscription to Guitar Player magazine, and one (1) signed copy of the Andy Timmons Band Resolution CD.
5. Entry and/or participation in this contest constitutes contestant’s/participant’s full unconditional agreement to and acceptance of these Contest Rules. Limit one (1) entry per contestant. In addition, by participating contestants agree to abide the decisions of the judges. No cash substitution, transfer or assignment of any prize is allowed. By participating, contestant agrees to execute an affidavit of eligibility and releases of liability and publicity if contestant wins any prize, and the affidavit and releases must be returned within seven (7) days of notification or an alternate winner may be selected. By accepting a prize, each winner grants to FN the right to use the winner’s name, voice, picture and/or likeness for purposes of advertising and publicity, without further permission or additional compensation (except where prohibited by law). All expenses on receipt and use of prizes and all federal, state, and local taxes, and the disclosure and/or reporting thereof, are the sole responsibility of each winner. By accepting a prize, each winner releases FN, its subsidiaries, affiliates, suppliers, agents and agencies from any and all liability for any loss, harm, damages, cost or expenses, including without limitation, property damages, personal injury and/or death, arising out of participation in this contest and/or the acceptance or use of a prize; and each winner agrees to execute any further documents FN deems necessary to effectuate such release.
